§ 1 1 SCOPE OF APPLICATION
§ 2 FORMATION OF A CONTRACT
The presentations of the goods in our internet shop represent non-binding requests to the customer to order goods. Therefore, the customer’s order from HANÜ Holzmanufaktur GmbH is an offer to us to conclude a purchase contract. We will confirm that we have received your order by sending an email to the email address you provided. In this e-mail, the ordered goods, their individual and total costs, any packaging and transport costs incurred, the total amount of the order and the cancellation policy are specified. This e-mail expressly does not represent an acceptance of the previous offer made by the customer to conclude a purchase contract. All offers from HANÜ Holzmanufaktur are non-binding. The purchase contract is only concluded when an express order confirmation is sent or the goods are delivered. If the deadline expires without result, the offer is deemed to have been rejected.
The text of the contract will be saved by us and the order data and our terms and conditions will be sent to you by email. You can also view the terms and conditions on our website at any time. For security reasons, your order details are no longer accessible via the Internet.
For shopping at calumetpipe.de we require a minimum age of 18 years. If the customer is misled about his age, HANÜ Holzmanufaktur GmbH expressly reserves the right to take legal action.

In the online shop, before sending the order, the customer has the opportunity to check the accuracy of the content, especially the price and quantity, and correct it if necessary. After sending the order to our web server, the order is considered binding and will be processed immediately.

§ 4 Prices, payment and minimum order value
§ 5 DELIVERY
The dispatch takes place with the Deutsche Post AG / DHL.
In the case of cash on delivery, there is a cash on delivery fee of EUR 7.00, which DHL charges directly upon delivery.
If the customer wants a delivery address that differs from the billing address, he should indicate this when placing the order. The customer is asked to check as soon as possible upon receipt of the goods whether the packages are undamaged and whether the correct products have been delivered in the correct number, in the event of incorrect deliveries or damage to have these acknowledged by the deliverer and then contact HANÜ Holzmanufaktur GmbH. The statutory warranty rights to which the customer is entitled are not affected by this.
The delivery takes place within Germany at the latest within four weeks (Mon-Fri excluding public holidays) after the conclusion of the contract (with cash on delivery).
From an order value of 100 EUR, delivery within Germany is free.
DHL insured parcel within Germany flat rate per order 7.50 EUR including VAT.
DHL registered mail within DE up to an order value of 40 EUR: 3.00 EUR including VAT.
Cash on delivery within DE under 250 EUR order value: EUR 12.00
DHL insured postal package within Europe: EUR 20.00
DHL insured parcel to Canada: EUR 25.00
DHL insured parcel to the USA: EUR 35.00
DHL insured parcel – to all other countries: EUR 40.00
§ 6 Right of withdrawal
§ 7 Guarantee
HANÜ Holzmanufaktur GmbH guarantees that the products delivered are free of material defects at the time of handover. The warranty is subject to legal regulations. For orders from entrepreneurs, the warranty is limited to one year.
In the event of a return due to a defect, the customer is asked to contact HANÜ Holzmanufaktur GmbH beforehand to discuss the form in which the return or collection will be carried out.
§ 8 liability
HANÜ Holzmanufaktur GmbH is only liable in cases in which it, a legal representative or a vicarious agent is guilty of willful intent or gross negligence. The above does not apply if there is liability for damage resulting from injury to life, limb or health, for liability under the Product Liability Act or in the event of a breach of essential contractual obligations. Essential contractual obligations are those obligations, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the customer can regularly rely. Except in the case of intent, gross negligence and damage from injury to life, limb or health, the amount of liability is limited to the damage typically foreseeable at the time the contract was concluded. This liability regulation does not cover claims under data protection law.
§ 9 Retention of title
HANÜ Holzmanufaktur GmbH retains ownership of all goods that it delivers to a customer until the purchase price and any shipping costs have been paid in full. If third parties access the reserved goods, the customer will point out the ownership of HANÜ Holzmanufaktur GmbH and inform them immediately. If the customer is in default of payment or if he culpably fails to fulfill other essential contractual obligations, HANÜ Holzmanufaktur GmbH is entitled to withdraw from the contract and to demand the return of the reserved goods or, if necessary, to demand the assignment of the customer’s claims for surrender against third parties.
